Terms & Conditions

  1. General
    1. These terms and conditions set out the terms on which any person ("you"; "your") may access, make use of and make Payments (as defined in clause 2.1) to Shelter The National Campaign For Homeless People Limited, company number 01038133 and registered charity number 263710 ("we"; "Shelter") on that part of the Shelter website designated by Shelter as being the "Shelter virtual city" ("the Shelter city").
    2. By accessing or using the Shelter website or making any Payment, you agree to be bound by these terms and conditions.
  2. Purchasing and amending parts of the Shelter city
    1. The provisions of this clause 2.1 provide the terms on which any person ("you"; "your") makes any Payment. A Payment shall be any payment made by you to Shelter with the intention that Shelter will thereafter create an image of a building ("a Building") to appear on that section of the Shelter website designated by Shelter as being the "Shelter virtual city" ("the Shelter city"), not being a payment in consideration of advertising for goods or services of any person.
    2. All Payments are donations to Shelter and no Payment shall be consideration in respect of any good or service or any other thing of value provided by Shelter.
    3. No creation or featuring of a Building on the Shelter website shall be consideration in respect of any Payment.
    4. No Payment will confer any right whatsoever on you over or in relation to any Building or in respect of any part of the Shelter website.
    5. Shelter shall not be under any obligation to refund any Payment to you.
  3. Designing a Building
    1. The final design of any Building is the absolute discretion of Shelter and Shelter may modify any Building design at any time.
    2. Shelter may at its sole discretion take Payments from any third party in respect of your Building.
  4. Homepage neighbourhood
    1. Shelter may at its discretion change the images and designs surrounding your Building ("the Neighbourhood").
    2. Shelter may remove any Building from the Shelter website at any time, at its discretion.
  5. Gift Aid
    1. Payments made by individuals are eligible for Gift Aid. However, payments not being Payments (in particular, payments made in respect of advertising) may not be eligible for Gift Aid.
  6. Posting messages
    1. Shelter may at its sole discretion remove any image or word or internet link from the Shelter website including, but not limited to any such which:
      1. Contain swear words or other objectionable language
      2. Offend or attack others
      3. Are racist, sexist, homophobic, sexually explicit, abusive or otherwise objectionable
      4. Appear to impersonate someone else
      5. Break the law or encourage unlawful activity
      6. Are written in anything other than English, Welsh or Gaelic
      7. Describe or encourage activities which could endanger the safety or well-being of others
    2. Any message that is posted on the website may be seen, collected and used by any other person. If you post any email or website details on the Shelter website you may receive unsolicited messages from other persons. You agree that you post any messages which you post on the Shelter website at your own risk.
  7. Uploading Messages on to the site
    1. Shelter may monitor and view all messages, images and links posted on the Shelter website from time to time. Shelter may at its discretion remove any message that it deems not to conform to its own policies from time to time in relation to the matters stated in clause 6.1 or for any other reason.
    2. Shelter reserves the right to change any part of the Shelter website and, in particular, the Shelter city.
  8. Advertising
    1. Any advertisements on this site must conform to the British Code of Advertising Practice and must accurately reflect the product and or service being advertised.
    2. Advertisements should be in line with Shelter's policies. If an advertisement is considered as not being in line with Shelter policy advertisements will be removed. This is at the discretion of Shelter.
    3. The publication of an advertisement by Shelter does not constitute endorsement of the advertiser, its products or services.
    4. Shelter will not be liable for any loss or damage caused by amendment or error.
    5. Shelter reserves the right to make any alteration it considers necessary or desirable to any advertising placed on the website.
    6. Shelter reserves the right to omit, suspend, or change the position of any advertising, even if it has already been accepted.
    7. All claims made in advertisements must be capable of being supported by appropriate evidence and must be made available to the Shelter upon request.
  9. Length of time the site will be live
    1. Subject to the other provisions of these terms and conditions, Shelter intends to operate the Shelter city part of the Shelter website until August 2008 or later. Notwithstanding this intention, Shelter may remove any Building or discontinue operation of the Shelter website or any part of it at any time.
  10. Disclaimer
    1. Shelter does not represent or warrant that the information accessible via the Shelter website is accurate, complete or up to date.
    2. Shelter will not be liable (to the fullest extent permitted at law) for any loss, damage or inconvenience to any person arising as a consequence of any use of or the inability to access or use the Shelter website or any information appearing on that website. This limitation shall not limit Shelter's liability to any person in respect of personal injury or death.
    3. Shelter takes no responsibility for the contents of linked websites and such links should not be taken as any endorsement by Shelter of any such link or any website to which any of them is linked. Shelter has no control over the availability at any time of any such linked webpage or website.
    4. Messages posted on the Shelter website by persons other than Shelter do not necessarily reflect Shelter's views. Shelter is not responsible for the content or accuracy of any such message. Shelter reserves the right to refuse access to the Shelter website of any person at any time and for any length of time, at its sole discretion
  11. Copyright
    1. You may not copy, reproduce, republish, post, distribute, transmit or modify in any way all or any part of the Shelter website.
  12. Collecting personal information
    1. We collect information from you, such as details you pass on to us when you make a donation, join a campaign, book a place on a training course, purchase goods or services or fill in any online form on the Shelter website. We also collect information when you respond to an appeal or take part in an action. This information helps us to know what incentives, appeals and actions are working well and assists Shelter in campaigning for decent housing for all.
  13. How we use your personal information
    1. The personal information we collect from you is used to provide you with information, services or products you have requested and for administration purposes. We also use this information to further our charitable aims, including campaigning and fundraising activities.
    2. We may need to share your information with our service providers, associated organisations and agents for these purposes. We do not disclose personal information to other organisations for direct marketing purposes. We may need to disclose your information if required to do so by law.

  14. Financial information
    1. We only collect the financial information that you knowingly supply when making a payment or donation, such as credit card or debit card payments, through the Shelter website. This information is encrypted and stored on secure servers so that your transaction can be completed.
  15. Site usage information
    1. We collect site usage information, using cookies, log files and page tagging techniques including JavaScript. This information gives us a better understanding of how the Shelter website is used, and how we can improve our services to our clients and supporters.
  16. Cookies
    1. Cookies are small text files that are often created when you visit a website, and which are stored in the cookie directory of your computer. A cookie is created when you visit the Shelter website. Shelter uses permanent cookies and session cookies. The permanent cookie stores a random number on your computer to help us count the number of times users return to our site. The session cookie lets us know which pages within our site you visit. Permanent cookies do not expire when you leave Shelter and may be used on subsequent visits to the site. Session cookies expire when you leave Shelter or switch off your computer.
    2. You can choose not to accept cookies, or delete existing cookies, by adjusting your internet security preferences. To do this, refer to the instructions for your browser in the 'help' menu.   17. Log files
    1. Log files record visitors' use of the site. We can collect information about site usage from the data contained in these logs which we obtain from third parties. Log files do not contain any personal information and they are not used to identify any individual patterns of use of the site.
  18. Page tagging
    1. We use JavaScript to aggregate and analyse customer usage patterns on the Shelter website domain. This provides us with data on your usability and behaviour. We use this information to make changes to the layout of the website and to the information in it. This does not collect any personal or identifiable information about users.
  19. Maintaining your privacy
    1. Some of the information on our websites relate to sensitive issues. If you would like to remove details of the pages you have viewed on our site from your computer, you can clear your browsing history. To do this, choose 'tools' from the top navigation bar on your browser, select 'internet options', and click on 'clear history'. Alternatively, refer to the instructions for your browser in the 'help' menu.
  20. Storing your information
    1. Personal information you submit on the Shelter website is stored on secure servers. Occasionally, in order to complete your request as outlined above, we may need to transfer personal information you submit to us to countries or jurisdictions outside the EEA which do not provide the same level of data protection. In such instances, we will ensure that a contract is put in place to make sure your details are protected. We will never sell or share your personal information with any other organisation besides Shelter, or Shelter Trading Limited.
  21. Changing your details

  22. Accessing your information
